Jury Award-Does The Judge Tell Jury How Much Your Case is Worth?

Somewhere along the way you got the impression that the judge who supervises your trial will be giving the jury his or her opinion about how much to award to you, or how much your case is worth. In New York, that simply does not happen in a jury trial. Instead, it is the jury's responsibility to determine how much to award once you have proven your case. The judge does not give the jury guidelines about the value of your injury. The judge does not tell the jury what he personally believes you should be entitled to. At the end of the case, during closing remarks, I will suggest to the jury an amount that I believe represents appropriate compensation for your injuries. The jury is free to agree with me, disagree with me, award you more than we asked for, award you what you asked for or award you less. Some bold defense attorneys make the argument that you are not entitled to any compensation, but if you are, to award no more than "X" dollars. Their thinking is that if they put a particular number in the mind of the jurors that will create a ceiling above which they will not award. Sometimes this works, sometimes it does not.
