Attorneys in the Harvey Weinstein case spoke during a press conference held outside the Los Angeles Superior Court on Wednesday, as the former movie producer pleaded not guilty to 11 counts of rape and sexual assault.

Weinstein’s attorney Mark Werksman quoted a statute of limitation and said the accusations are “from long, long ago, they’re uncorroborated, and we do expect that after a trial in this matter - if we have a fair trial in this case - then Mr. Weinstein will be acquitted of these charges.”

“They brought allegations that can’t be substantiated or corroborated by any forensic evidence,” he added.

“This is not television, this is real life, this is a real case. I’m not going to comment on whether it’s true that there is no forensic evidence, but I can assure you, it is not necessary to have forensic evidence in order for this case to be proven. Allegations in sexual assault and rape often take a long time for a victim to report, so the idea that they may not have disclosed to any law enforcement officer for so many years does not mean that those are not credible,” responded Allred.

“It’s hard when people keep a secret for many years, as some may have, but some may have told others - I’m not going to comment which ones did. But I can assure you that as to my clients, there’s certainly much more evidence than just their testimony. Although I think their testimony alone should be enough,” she added.

Weinstein is currently serving a 23-year prison sentence at a Buffalo prison after he was found guilty in New York City last year on two counts of sexual assault, including rape.

In Los Angeles, he faces four counts of rape, four counts of forcible oral copulation, two counts of sexual battery by restraint and one count of sexual penetration by use of force.

We filed a demurrer challenging three of the counts, on statute of limitations grounds. We welcome an opportunity to address these charges in court. They’re baseless, they’re from long, long ago, they’re uncorroborated, and we do expect that after a trial in this matter - if we have a fair trial in this case, then Mr. Weinstein will be acquitted of these charges.”

SOT, Mark Werksman, Harvey Weinstein’s lawyer: “The big picture is that these allegations stem from many years ago, that’s the problem the district attorney’s office is going to face, and that’s the problem all of these accusers face in that they brought allegations that can’t be substantiated or corroborated by any forensic evidence, any contemporaneous reporting, any credible witnesses. And so that’s one of the fundamental unfairness that we face in this case, it’s that these charges do stem from so many years ago. Three of the chargers are absolutely beyond the statute of limitation and must as a matter of law be dismissed. And we’ve addressed that in our demurrer.”
